Terms of Service
Last Updated: October 4, 2026
About These Terms
These terms are an agreement between you and Capa CMS, operated by Kirby Campbell, Lincoln, Rhode Island, USA (“we”, “us”). They cover your use of Capa: the Capa app, the Capa API, the SDK, the MCP server and capacms.com.
1. Acceptance of Terms
By using Capa, you agree to these terms and our policies, including our Privacy Policy.
2. Description of the Service
Capa is a content management system. It offers an app for editing content, APIs and an SDK for reading it, an MCP server for AI agents, and integrations with tools like Google sign-in and Shopify.
3. Eligibility
You must be at least 18 years old to use Capa.
4. User Accounts
- Provide accurate information during registration.
- Keep your credentials secure and report unauthorized access.
5. User Content
- You retain ownership of your content but grant us a license to display and distribute it within the platform.
- Ensure your content complies with applicable laws.
6. Acceptable Use
- Do not use Capa for illegal activities or harmful purposes.
- Respect the intellectual property rights of others.
7. APIs and Integrations
Use APIs in compliance with our documentation. Respect terms of third-party integrations like Google APIs.
8. API Keys
- API keys give access to your project's content. Keep them secret. The one exception is a read-only production key that you put in a website or app on purpose, as our docs describe.
- If a key may have been exposed, rotate or deactivate it in the Capa app straight away.
- We may deactivate a key that has leaked or is used against these terms. We will tell the project's owner when we do.
- You are responsible for what is done with your project's keys.
9. MCP and Agent Access
- You can connect AI agents to Capa through our MCP server or the API, with a key you create.
- You decide which agents get a key and what each key may do. Give an agent only the access it needs.
- You are responsible for what an agent does with a key you gave it, as if you had done it yourself.
- To stop an agent, deactivate its key.
10. The Assistant
- The Assistant is the AI chat in the Capa app. When you ask, it drafts entries, edits, alt text and changes to your models.
- When you use it, what you type and the parts of your project it reads to answer, such as entries, model fields, file names and images, are sent to our AI model provider to produce the answer.
- AI output can be wrong. The Assistant never publishes: what it writes waits as a draft or a proposal until a person approves it. Review its work before you publish it. You are responsible for what you publish.
- Use is limited by your plan's monthly Assistant credits, and by limits on how long a message can be and how many you can send in a minute. When a project's credits run out, the Assistant stops until the next month. It may also be unavailable for a time, for example when our provider is busy or a daily limit is reached.
11. Usage Limits and Fair Use
- Each plan has limits, such as how many models a project can have and how much media it can store. When a project reaches one, Capa refuses what would go past it, like a new model or an upload, until you upgrade or make room.
- To keep Capa fast for everyone, we limit how many requests a key or a project can run at once, and how large a request or an upload can be. Requests past these limits may wait or be refused.
- Do not try to get around a limit.
- If a project's use puts Capa or other customers at risk, we may limit it, and we will tell you.
12. Fees and Payment
Certain features may require fees as outlined on our pricing page.
13. Termination
We may suspend or terminate your account for violations of these terms.
14. Disclaimer of Warranties
Unless a written agreement with us says otherwise, Capa is provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that Capa will always be available or free of errors.
15. Limitation of Liability
- To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data.
- Our total liability for all claims about Capa or these terms is limited to the fees you paid us for Capa in the 12 months before the claim.
- Where the law does not allow a limit like these, it applies only as far as the law allows.
16. Indemnity
You will defend and indemnify us against any claim, loss or cost, including reasonable legal fees, that arises from your content, from the use of your project's API keys, or from what an agent you connected to Capa does.
17. Governing Law
These terms are governed by the laws of the State of Rhode Island, USA. Any dispute will be resolved in the state or federal courts located in Rhode Island.
